Does an accessibility overlay help defend an ADA website claim?

Published 2026-09-14

An overlay subscription by itself is weak evidence because it does not prove the underlying storefront works for keyboard and screen reader users. A stronger record shows source-level remediation, repeated testing, prompt repairs, and verification before the claim. If an overlay is present, treat it as a visitor preference tool, not as a substitute for fixing the site.

What counsel needs to show

The useful story is a real program: known scope, recurring tests, accountable owners, completed repairs, and a current status report. A receipt shows a purchase, not that blocked tasks were found or fixed.

Avoid the after-the-letter shortcut

Installing a widget after receiving a letter does not repair the cited code and can create a poor timeline. Preserve the site state, engage counsel, audit the actual flows, and start verified remediation immediately.
